1. What this is
This Host Agreement is for anyone who hosts a PopBy on MyPopBy: posting a link, inviting friends or the public, announcing a visit in a real city, and publishing a date. You do not need to be a professional entertainer or influencer — if you publish a PopBy, you are a host under this agreement.
It is accepted when you create a MyPopBy account. It sits alongside the Terms of Service and the Privacy Policy. Campaigns, pledges, fees on a seat, and refunds between you and someone pledging are also covered by the Host–Pledger Terms and by what the product shows when you publish.
Creating an account is how you accept this agreement. If you do not agree, do not create an account.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You agree that you are acting for yourself, or that you have authority to bind the person or business you represent. The service is intended for users in the United States.
3. Authentic identity and socials
Hosting tools stay incomplete until you verify at least one social account people already use to find you (YouTube, Instagram, TikTok, X, Twitch, or LinkedIn). Verification links that account to your MyPopBy login. It is not a separate MyPopBy account.
You agree that the profile, handle, and linked socials are yours, or that you have permission to use them. You will not impersonate another person, buy or borrow a verification, or hold out someone else’s account as yours. We may refuse, hide, or remove a profile that we reasonably believe is not authentic.
4. Fees and payouts
Publishing and payouts follow the fees shown in the product and in the Host–Pledger Terms. Those product screens control if they conflict with this summary.
- PopBy retains 10% of each captured pledge, ticket and Boost alike, as a platform fee. You keep 90%. PopBy pays the card processing fee on each charge out of its fees.
- Founding offer. If you are one of the first 1,000 creators to publish a PopBy, PopBy retains 3% instead of 10% on your first PopBy, including tickets sold later on that PopBy’s event link, so you keep 97% of it. Whether you qualify is set when you publish that first PopBy, by the order in which creators publish.
- Fans pay a separate $1 seat fee when a seat is charged, shown inside their all-in price. That seat fee stays with MyPopBy. It is not part of Total Demand, rank, or your payout. Pledges made under the earlier $3 booking fee are charged $1. A pledge already captured is not charged the seat fee again.
- When a fan is refunded, you owe the card network’s fee on that charge, and a refund you start also owes the seat fee, as shown in the product. Those amounts come out of a future payout if your share was already paid.
- A payout requires a connected payout account. If payouts are not connected, nothing is charged and no payout is claimed.
- Trip planning may show an expected capture rate (about 92% of seated pledges). That estimate is not money on hand and is not a guarantee.
- Your share of each charge is added to your payout balance. We pay out your available balance automatically every Tuesday when it is at least $25. A smaller balance is paid out anyway once four weeks have passed since your last payout, and you can request a payout of any available balance of $5 or more at any time from your settings. New charges can take several days to become available, and payouts can be delayed by Stripe or MyPopBy review holds (fraud, disputes, identity checks). If you disconnect payouts or close your account, we pay out any remaining available balance regardless of size, less refunds, chargebacks, and amounts you owe us.
You are responsible for taxes that apply to you.
Fans who tap “Keep me posted” asked for an email. They are not part of Total Demand, seating, or payouts.
5. Publishing a PopBy
Publishing requires this agreement and a connected payout account. Highest-pledging fans are seated first when the room is full. Fans at or above your minimum entry fee, up to your attendance maximum, are charged when you publish (plus the $1 seat fee when a seat is charged). The part of a fan’s pledge above your minimum entry fee is their Boost. Boosts seat fans first when the room is full. If you set perks for Boost levels on a PopBy, you are responsible for delivering them to the fans who qualify. Declined cards and fans below the minimum get the windows shown in the product. An event with zero backers opens the public link at publish.
A freed seat may be offered down the waitlist. A second PopBy in the same city must not double-charge a fan already seated for you there.
6. Prohibited use
You may host PopBys only for visits and hire of the kind MyPopBy offers: performances, classes, meals, meetups, livestreams, merch moments, and speaking, creative, or consulting hire. You will follow the Terms of Service, the Host–Pledger Terms, and our payment networks’ rules.
You may not use hosting tools to break the law, infringe someone else’s rights, impersonate another person, evade fees, or list something our payment providers disallow. We may remove a listing or restrict the account when a use falls outside that offering.
7. Termination
You may stop hosting by closing the account. We may suspend or end hosting access for safety, legal compliance, a payment-network requirement, nonpayment, inauthentic identity, or a material breach of this agreement, the Terms of Service, or the Host–Pledger Terms. Fees already earned or owed, and any section that should survive, survive termination.
Turning hosting tools on does not by itself publish an event or charge a fan.
8. Changes
We may update this agreement by posting a new version and changing the effective date. If a change is material, we may ask you to continue again before hosting tools stay available. Continued use after the new date, when we have presented the update, means you accept it.
9. The rest of the contract
The Terms of Service govern the service generally, including disclaimers, liability limits, indemnity, Kansas law, and Sedgwick County courts. The Host–Pledger Terms govern each campaign and pledge. If this agreement conflicts with the Terms of Service on a general account rule, the Terms of Service control. If it conflicts with the Host–Pledger Terms on a pledge or a payout, the Host–Pledger Terms control. The product screen controls over this summary where it states a specific fee or date.
